Jonathan Taylor and Liz Riley from the London Sports Group successfully represented the World Anti-Doping Agency in a high profile arbitration before CAS in the British Olympic Association bye-law case concerning the validity of the BOA’s bye-law rendering certain athletes previously convicted of a doping violation ‘ineligible for selection’ for the Olympic Games, the central issue being the compatibility of the bye-law with the overarching World Anti-Doping Code (Code).

We continue to strengthen our capability in Asia with the arrival last week of partner Catherine Mun in our Dispute Resolution team in Hong Kong.

Catherine has extensive experience advising on complex domestic and international commercial, construction and engineering disputes and arbitrations, and related advisory work. As one of the few Hong-Kong-based lawyers with China-related international arbitration experience, Catherine has particularly focused on arbitration proceedings on behalf of major international corporations based in Europe, the US and the wider Asian region.

Senior Associate Bartłomiej Niewczas joined our office in Warsaw to head up our Polish Dispute Resolution team. Bartłomiej has significant experience in handling large disputes and arbitrations for corporate clients with particular expertise in un-fair competition acts, cross-border insolvency, construction disputes, intellectual property and securities. He joins from Skanska Poland SA where he was head of the litigation team.

A Singapore team led by Susan de Silva (Employment), with support from Boey Swee Siang (Dispute Resolution), Denning Tan, Jonathan Kao (both Corporate) and, on competition law, Sandra Seah and Morten Nissen (Belgium), has successfully advised an international aviation group client in two cases before the Industrial Arbitration Court (IAC). In the first case, the three-member panel led by IAC president, Justice Chan Seng Onn, ruled in favour of our client, stating that the case presented by the other side was “flawed in principle”.

An Arbitration team in Helsinki has won a long-awaited successful verdict for a market leading chemical producer in Finland, in a proceeding against one of Finland's largest insurance companies. The dispute related to a significant insurance compensation payment  following a halt in production at the plant.

The Bird & Bird team was led by partner Tom Vapaavuori together with senior associate Jarno Sulasalmi and the arbitration panel consisted of three high profile members. The verdict was reached in mid-November, following proceedings lasting almost two years.

Annet van Hooft joined Bird & Bird as “Senior European Counsel” to develop its international arbitration practice both in Paris and internationally.

Annet specializes in international commercial arbitration. She represents clients in arbitrations under the rules of various international arbitral institutions, including the International Court of Arbitration (ICC), the Stockholm Chamber of Commerce (SCC), and the World Intellectual Property Organization (WIPO). She also acts as counsel in ad hoc proceedings. She is experienced in several different legal systems and a wide variety of sectors, such as energy, pharmaceuticals, distribution and licensing, and mergers and acquisitions. 

Annet regularly sits as arbitrator in international disputes.

In Germany, the International Council of Arbitration for Sport (ICAS) has reappointed Düsseldorf Senior European Consultant Martin Schimke as a member of the Court of Arbitration for Sport (CAS) until 2014. The CAS has 270 arbitrators, from 87 countries - chosen for their specialist knowledge of arbitration and sports law. Martin has been on the list of CAS arbitrators since 1999 and  during this time has been involved as either Chairman or Co-Arbitrator in almost 70 cases from all fields of individual and team sport.

Jane Player and Naresh Mahtani of ATMD Bird & Bird LLP Singapore, were invited by Crawford Bayley & Co to talk to a selected invited audience of leading Indian companies on Arbitration Rules in Mumbai. They invited Ajay Thomas, Registrar of LCIA India, to share their platform. Jane Player, Naresh Mahtani and Ajay Thomas dedicated a joint session to (i) the difference between arbitration, litigation and mediation, (ii) new ADR methods and (iii) the choice of substantive law, procedural law and seat of arbitration. They also carried out a comparative analysis of the ICC, LCIA and SIAC Arbitration Rules as well as a presentation of the LCIA-India Arbitration Rules entered in force in April 2010. The very successful event took place on 19 November 2010.

Sarah Walker took part in a mock arbitration staged as part of the Singapore International Arbitration Centre (SIAC)’s conference to celebrate the opening of Maxwell Chambers in January 2010.  As part of the Programme of celebration, Christopher Lau QC and Bird & Bird hosted a dinner for conference delegates and friends of the firm.  Alban Kang, Naresh Mahtani, Boey Swee Siang and Sarah Walker hosted the event for Bird & Bird.  An article covering the opening of Maxwell Chambers prepared by Boey Swee Siang is attached.
