Bird & Bird Data Protection Bulletin

Summer 2012

Welcome to the summer edition of the Data Protection Bulletin.

June and July brought a busy period of activity in terms of UK enforcement, with the ICO handing out four major fines including the second largest monetary penalty ever. There have also been major developments in cloud computing, the Eurodac fingerprinting system, as well as guidance and opinions on cookies and the processing of data gathered by energy smart-meters.

Highlights include:

  • A draft of the controversial Communications Data Bill has been published;
  • A revised draft of the EU Data Protection Regulation has also been leaked following the draft issued by the Council of Ministers on January 2012;
  • Binding Corporate Rules for CitiGroup have been approved by the ICO, allowing the transfer of personal data to affiliates outside of the EEA;
  • A case examining the relationship between the Freedom of Information and Data Protection Laws, decided by the First-tier (Information Rights) Tribunal.
