Adidas has lost it’s 24-year-long fight with H&M in the Dutch Supreme Court over an alleged infringement by H&M of Adidas’ three-stripe trade mark

The Dutch Supreme Court has rejected a final appeal brought by Adidas over the use of a two-stripe sign by H&M as part of its ‘Work Out’ clothing line. Adidas alleged that the sign infringed the company’s three-stripe trade mark. The decision acts as a useful guide on the limits to which a registered trade mark can be protected.
