We are pleased to invite you to a celebration event for our newest partner hire, Olivier Bertin! Bringing over 30 years of experience to the firm, Olivier specialises in tax litigation working closely with leading Belgian businesses across the media, tech, life sciences and not-for-profit sectors. Olivier is a strong addition to our team and will further build our tax practice alongside tax partner Brent Springael.
During the event, Olivier and Brent will present on the updated Belgian tax regime for copyright royalties, stemming from Omnibus Law of 26 December 2022 and in effect as of 1 January 2023.
Since its initial introduction in 2008, this tax regime has become part of the standard remuneration package of many employees engaged in activities with some creativity (marketing personnel, content creators, designers, photographers, journalists, software developers, etc.). Any potential limitation of this regime could therefore have a direct impact on employers if the changes would result in a lower net income for the targeted employees or require a salary increase to guarantee an equal net income. The IT sector, in particular, seems to be the scapegoat. The other sectors remain otherwise unaffected, except perhaps a possible limit on the amount that can be paid out as copyright royalties.
Take a look at our team's high-level summary of the new copyright regime (in NL-FR-EN) and their take on the practical impact these new rules will have on businesses.
