Ofcom, the UK’s appointed online safety regulator, has recently published its first consultation on its formal guidance under the Online Safety Act. This includes its draft codes of practice and guidance for ‘Protecting People from Illegal Harms Online’
As drafted, the documents will impose some substantial operational changes on affected businesses, and still leaves significant areas of uncertainty.

What is the Online Safety Act?
It is estimated that more than 20,000 entities in the UK alone may be in scope of the Act. The Act applies if you have an online presence and if this allows users to connect and share any kind of content, or if your service allows users to search sites and databases. It imposes a number of obligations on such services to keep people in the UK, especially children, safe online, particularly from illegal and pornographic content. The first Ofcom consultation, on illegal harms guidance, closes on 23 February 2024.
