The highlights this month are:
New "Code of Practice on Privacy Notices, transparency and control" published by the ICO: According to the ICO, businesses that follow this Code will be well placed to comply with the forthcoming GDPR. The Code outlines a number of best practices, including how to obtain consent, determining who the data controller(s) is/are in complex data sharing scenarios and the use of new technologies to obtain consent.
TLT and others v Secretary of State for the Home Department: This High Court case examines the legal principles the Court will use to assess damages in privacy cases, as well as demonstrating how the Court will analyse the strengths and weaknesses of evidence in support of damages for distress.
Camera di Commercio, Industria, Artigianato e Agricoltura di Lecce v Salvatore Manni: Ahead of the CJEU decision, the Advocate General delivered his Opinion, concluding that a public registry of companies is not required to erase or anonymise personal data upon an individual's request, nor to restrict public access to such data.
