UPC 360°- Meet the Experts Litigating Before the UPC

We are delighted to invite you to our UPC 360° conference, a unique opportunity to gain practical insights into the workings of the Unified Patent Court (UPC). Over the past year, our international team has handled numerous cases before the UPC, and we’re eager to share our real-world experiences and key takeaways with you with an international line up!

The conference will feature a plenary session followed by your choice of two series of workshops out of three, designed to spark meaningful discussions on the topics that matter most to you. This is an excellent chance to learn from hands-on expertise and engage with fellow professionals facing similar challenges. 

We will conclude the event with a cocktail reception, offering further opportunities for networking and conversation.

Plenary session: Evidence before the UPC vs. national courts

Evidence before the UPC differs from what we are used to before national courts. How does this change our approach to litigation? How should cases be prepared? How can evidence be obtained during proceedings? How is confidentiality handled? What about “saisie-contrefaçon”?

Workshop 1: Injunctions 

Cross border injunctions, whether provisional or permanent, are one of the most powerful tools of the UPC system. How can you best use this tactical weapon? On the other hand, how can the risk of injunctions be mitigated?

Workshop 2: Validity and infringement 

The UPC has a specific approach to validity and infringement (opportunity to amend the claims via auxiliary requests, presence of a technically qualified judge…) and is setting rules that may differ from the EPO (claim construction, inventive step…). How can you best navigate these technical aspects?
