Bird & Bird advises Costa on landmark deal with M&S

International law firm Bird & Bird has advised long-standing client, Costa Coffee (Costa), on a transaction with Marks & Spencer (M&S) to allow Costa to serve M&S food throughout the UK. By serving M&S food, Costa aims to drive more footfall into its stores by improving Costa’s current food range and M&S will gain an entirely new network to increase its food sales.

The deal marks months of intense and complex legal negotiations on various agreements. The Bird & Bird team was led by Commercial Partner, Robert Turner, with support from Associate Nikesh Mistry (Commercial), Legal Director Saskia King and Associate Ariane Le Strat (Competition & EU), Partners Victoria Hobbs (Dispute Resolution) and James Mullock (Data Protection) and Associate James Pearson (IP).

Sunita Savjani, General Counsel at Costa Coffee says: “This is a monumental deal for Costa. Thank you to each member of the Bird & Bird team involved for all your hard work. It’s a pleasure to work with such a committed, energetic and positive team.”

Robert Turner, lead partner at Bird & Bird adds: “It was a pleasure to be involved in such a positive collaboration between two of Britain’s best known consumer brands – Costa and M&S. I look forward to working with them again in future.”
