Reports of Trade Mark Cases for CIPA - May 2018

This month we report on Advocate-General Szpunar's Opinion on whether the shape exclusion in Article 3(1)(e)(iii) is applicable to non-three dimensional properties such as colour and shape (Christian Louboutin v Van Haren Schoenen). We also report on the decision in Henry Martinez v Prick Me Baby One More Time Ltd regarding consumer confusion between two marks featuring the word PRICK.
